Abstract

Patient rights sit at the intersection of constitutional law, medical ethics, health policy, and human rights jurisprudence, yet health systems across jurisdictions continue to exhibit systemic failures in translating normative entitlements into enforceable protections. This paper undertakes a scientific, analytical reality-exposing review of the legal architecture governing patient rights, situating doctrinal analysis within a scoping-review methodology adapted from the PRISMA-ScR framework. It synthesizes international human-rights instruments, comparative case law from the United Kingdom, United States, Australia, and India, and empirical health-systems literature to examine how legal strategy — rather than aspirational declaration — can close the gap between codified patient entitlements and lived clinical experience. The review finds that jurisdictions with codified, justiciable rights to health, independent regulatory oversight, and enforceable informed-consent doctrine demonstrate measurably lower rates of preventable harm and higher patient-reported procedural justice, while jurisdictions relying on voluntary charters or fragmented regulation show persistent accountability deficits. The paper presents a comparative table of patient-rights frameworks across four jurisdictions, a PRISMA-style evidence-selection flow, and a synthesis of divergent scholarly perspectives — biomedical ethics, health-systems economics, and critical human-rights theory — on the causes and remedies of systemic healthcare injustice. It concludes that a strategic legal approach combining constitutional entitlement, statutory specificity, independent adjudication, and data-driven regulatory feedback loops offers the most durable pathway toward accountable, rights-respecting health systems.
