Abstract

Female foeticide represents one of the most severe forms of gender-based violence in contemporary India, constituting what scholars increasingly recognize as a "silent genocide." This paper examines the complex socio-legal dimensions of female foeticide in India through a comprehensive analysis of cultural, economic, legal, and technological factors that perpetuate this practice. Drawing on extensive empirical data, case studies, and legal precedents, this research reveals how deeply entrenched patriarchal structures, combined with modern medical technology and inadequate legal enforcement, have created a systematic elimination of female fetuses. The study employs a mixed-methods approach, analyzing demographic data from the last three decades alongside qualitative insights from affected communities. Key findings indicate that despite progressive legislation such as the Pre-Conception and Pre-Natal Diagnostic Techniques (PCPNDT) Act of 1994, the practice persists due to weak implementation, cultural resistance, and the commodification of sex determination technologies. The paper argues that female foeticide constitutes a form of genocide as defined by international law, given its systematic nature and intent to eliminate a specific group. The research concludes with comprehensive policy recommendations focusing on legal reform, technological regulation, and cultural transformation strategies. This study contributes to the growing body of literature on gender-based violence and provides a framework for understanding female foeticide as both a human rights violation and a threat to India's demographic stability.
